Terms of Service
1. About these terms
These terms govern your use of the ViennaScan website and our radiology booking and coordination service, operated by [LEGAL ENTITY NAME], [LEGAL FORM], registered at [REGISTERED ADDRESS] (“ViennaScan”, “we”, “us”). By submitting a request or using the service, you agree to these terms.
2. What our service is — and is not
ViennaScan is an independent booking and coordination service. We help you arrange a private radiology appointment (such as a PET-CT, MRI or CT) at an accredited institute in Vienna, handle the logistics, and help your results reach your own doctor.
We are not a medical provider. We do not perform examinations, do not interpret images, and do not provide medical advice, diagnosis or treatment. All clinical services are provided by independent, accredited radiology institutes, and all medical decisions are made by qualified physicians — the institute’s radiologists and your own treating doctors. Using our service does not create a doctor–patient relationship with ViennaScan. Please also read our Medical Disclaimer.
3. Eligibility
You must be at least 18 years old and able to enter into a contract. A valid referral from a doctor is normally required for the scan; we will tell you what is needed for your specific case.
4. How the service works
- You send us your request and, when ready, your referral.
- We review it and send you a written plan with what is possible, the timing, and a clear quote.
- If you accept, we arrange the appointment at a partner institute and help with the practical details.
- You receive your imaging (DICOM) and report, and — on request — help getting them to your doctor.
A booking is only confirmed once the institute confirms it. Appointment availability is not guaranteed until then.
5. Fees & payment
- The scan is paid directly to the radiology institute at its own prices. We do not receive commission from clinics.
- Our coordination fee is a flat fee shown to you upfront in your plan, before you commit. It covers booking, paperwork, logistics, language support and helping deliver your results.
- Prices shown on the website are indicative; the institute confirms the exact scan price for your case. [State how/when the coordination fee is invoiced and accepted payment methods.]
- All fees are stated [inclusive/exclusive] of any applicable taxes.
6. Your right of withdrawal (distance contracts)
As a consumer entering a distance contract, you generally have the right to withdraw within 14 days without giving a reason. If you ask us to begin coordinating before that period ends, you can still withdraw, but you may owe a proportionate amount for services already provided; once the service has been fully performed at your express request, the right to withdraw is lost. [Attach a model withdrawal form and confirm the exact wording with your lawyer.]
7. Cancellations, changes & refunds
You may ask to change or cancel a request at any time before the appointment is confirmed. After confirmation, the institute’s own cancellation and refund rules apply to the scan, and we will explain them to you. [Define your coordination-fee refund policy here.]
8. Your responsibilities
- Give accurate, complete information and a valid referral where required.
- Arrange your own travel, accommodation, insurance and any visa, and ensure you are fit to travel.
- Follow the institute’s preparation instructions for your scan.
9. Reimbursement
Most patients who travel to avoid a waiting list pay out of pocket. EU cross-border healthcare rules may let you reclaim part of the cost from your home insurer, usually only up to your home tariff and often only with prior authorisation. We can point you to your national contact point, but we do not promise any reimbursement and you should plan as if you are self-paying.
10. No medical guarantees & limitation of liability
We provide the coordination service with reasonable care and skill, but we do not guarantee any medical outcome, diagnosis, or the availability of any particular appointment. We are not responsible for the clinical services, acts or omissions of the independent radiology institutes or any physician.
To the fullest extent permitted by law, our total liability arising from the service is limited to [e.g. the amount of the coordination fee you paid], and we are not liable for indirect or consequential loss. Nothing in these terms limits any liability that cannot lawfully be limited, including your mandatory rights as a consumer.
11. Intellectual property
The website content, branding and materials are owned by [LEGAL ENTITY NAME] and may not be copied or reused without permission.
12. Privacy
We handle your personal and health data as described in our Privacy Policy.
13. Complaints & dispute resolution
If something goes wrong, contact us first at [CONTACT EMAIL] and we will try to resolve it. Consumers in the EU may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr. [Add any competent consumer arbitration board, if applicable.]
14. Governing law & jurisdiction
These terms are governed by [Austrian] law. If you are a consumer, you also keep the protection of any mandatory provisions of the law of your country of residence, and may bring proceedings in the courts that the applicable consumer rules allow.
15. Changes to these terms
We may update these terms as the service develops. The version in force is the one published here on the date you submit your request, shown by the “last updated” date above.
